Refund Policy

1. Scope and Application
This Refund Policy explains how payments, cancellations, downgrades, and refunds work for paid EMALINO subscriptions. It applies to paid plans billed through our payment processor. The free plan involves no payment and is not covered by this policy. This Refund Policy forms part of, and should be read together with, our Terms of Service and Privacy Policy.
2. Subscriptions Are Billed in Advance
Paid plans are sold as recurring subscriptions and are billed in advance for each billing period, either monthly or annually depending on the plan you choose. By starting a paid subscription you authorise us, through our payment processor, to charge the applicable fee at the start of each billing period until you cancel. Each payment buys access to the Service for that billing period.
3. No Refunds Once a Billing Period Has Started
Once a billing period has started, the fee for that period is non-refundable. This applies whether you are billed monthly or annually, and whether or not you actually use the Service during the period. We do not provide pro-rata refunds for the unused part of a billing period, and cancelling or downgrading part-way through a period does not refund the period you are already in. This is the standard practice for subscription software services. The only exceptions are the statutory consumer rights described in Section 6 and the limited cases listed in Section 7.
4. Cancelling or Downgrading Your Subscription
You can cancel or downgrade your subscription at any time from your workspace settings.
- Cancellation stops the next renewal. Your paid access continues until the end of the billing period you have already paid for, and you are not charged again. Cancellation takes effect at the end of the current period, not immediately.
- Downgrading to a lower-priced or free plan takes effect at the start of your next billing period. You keep your current plan until then, and the change does not refund the current period.
To avoid being charged for the next period, cancel at least 24 hours before your renewal date.
- Cancellation stops the next renewal. Your paid access continues until the end of the billing period you have already paid for, and you are not charged again. Cancellation takes effect at the end of the current period, not immediately.
- Downgrading to a lower-priced or free plan takes effect at the start of your next billing period. You keep your current plan until then, and the change does not refund the current period.
To avoid being charged for the next period, cancel at least 24 hours before your renewal date.
5. Try Before You Pay
We want you to be sure before you pay. The free plan lets you use EMALINO for as long as you like at no cost, and selected paid plans include a free trial at signup with no charge until the trial ends. Because you can evaluate the Service for free before any payment is taken, we do not offer a separate money-back guarantee on paid periods. If your plan includes a free trial, you can cancel during the trial and you will not be charged.
6. EU, EEA and UK Consumers: Right of Withdrawal
If you are a consumer resident in the European Union, the European Economic Area, or the United Kingdom, you have a statutory right to withdraw from a distance contract within 14 days, under Directive 2011/83/EU, the UK Consumer Contracts Regulations, and, in the Netherlands, Article 6:230o of the Burgerlijk Wetboek.
EMALINO is an ongoing online service. When you start a paid subscription you expressly request that we begin providing the Service immediately, and you acknowledge that:
- once the Service has been fully supplied for the period, your right of withdrawal is lost; and
- if you withdraw within the 14-day period after we have begun, you must pay a proportionate amount for the access already provided up to the moment you tell us you are withdrawing.
If you exercise this right within 14 days, we will refund the amount you paid for the current period, less a proportionate amount for the time the Service was available to you. You may use the statutory model withdrawal form, which we provide on request, or simply email us. This right applies to consumers only. Business customers, and anyone acting for purposes relating to their trade, business, or profession, are not covered by this consumer right.

7. Limited Exceptions
Outside the statutory right above, we may still issue a refund in these cases:
- Billing errors: a duplicate charge, or a charge made in error, is refunded in full for the incorrect amount.
- Unauthorised charges: a confirmed charge you did not authorise is refunded in full.
- Prolonged service outage: a confirmed, continuous unavailability of the Service exceeding 48 hours may be refunded on a pro-rata basis for the affected period, at our reasonable discretion.
- Where required by law: we always honour refunds that applicable consumer law requires.
Except where the law requires otherwise, refunds outside the statutory right of withdrawal are granted at our reasonable discretion.

8. Free Plan
The free plan involves no payment, so no refund is owed. Deleting a free account does not entitle you to any credit or payment.
9. How to Cancel or Request a Refund
To cancel or downgrade, use the subscription options in your workspace settings. This is the fastest way to stop future billing. To ask about a billing error, an unauthorised charge, or a statutory withdrawal, email support@emalino.com from the email address on your account, and include your account email and the transaction or invoice reference.
10. How Approved Refunds Are Processed
Approved refunds are returned to your original payment method through our payment processor, normally within 5 to 10 business days. We do not offer cash or bank-transfer alternatives. Where applicable, value-added tax (VAT) is adjusted together with the refunded amount.
11. Cancellation Is Not Account Deletion
Cancelling a subscription and deleting your account are separate actions. Cancelling stops billing but keeps your data until your account is deleted. Requesting a refund does not delete your data, and deleting your account does not by itself generate a refund. 12. Changes to This Policy
We may update this Refund Policy to reflect changes in our practices or legal requirements. We will notify paid subscribers of material changes at least 30 days in advance, by email or in-app notice. Changes do not apply retroactively to a billing period you have already paid for. Continued use of a paid plan after the changes take effect constitutes acceptance of the updated policy.
13. Governing Law and Contact
This Refund Policy is governed by the laws of The Netherlands, without affecting the mandatory consumer-protection rights you have in your country of residence. Disputes may be brought before the competent courts of The Netherlands. EU consumers may also be entitled to use an alternative dispute resolution (ADR) body in their country of residence.
